1. Who we are

The web site www.inmobiliariaelpuerto.com (hereinafter, the “Web Site” or the “Portal”), is operated by the company LOS ALCORES DEL PONIENTE S.L. (Hereinafter, “El Puerto”), with CIF B04810958, and registered office C/Galera, nº3 Bajo 04711, incorporated in Almerimar El Ejido (Almería).

2. General Conditions of Use of the Portal

2.1 Authorized Use

The present Legal Notice establishes the general conditions of use (hereinafter, “General Conditions”) that regulate the use of the services of the information society that El Puerto makes available to the users of the Internet network through the Web Site. Thus, the access and use of the Web Site implies that the user of the same (hereinafter, the “User”) accepts in its entirety these General Conditions, as well as the instructions, recommendations or particular conditions that are indicated in each specific case. In this regard, the User must take into consideration that some of the services provided through the Website may be subject to special conditions, which will complete and/or, where appropriate, replace the content of these General Conditions, and which must be accepted by the User before the corresponding service is provided. If the User does not accept the General Conditions, he/she must not use and/or is not authorized to use this Web Site.

Access to the Web Site is free of charge, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.

The User agrees not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of El Puerto or third parties. The use of the Website by the User in no way implies the transfer of any intellectual and/or industrial property rights over the Portal, its contents and/or the distinctive signs of El Puerto. To this effect, by means of the present General Conditions it is expressly forbidden to the User the reproduction, transformation, distribution, public communication, making available, extraction and/or reuse of the Website, its contents and/or the distinctive signs of El Puerto, except in those cases in which it is legally permitted.

Notwithstanding the foregoing, El Puerto allows the User to browse the Website or make copies or extracts for personal and non-commercial purposes.

2.3 Limitation of liability

The User acknowledges and accepts that, although The Port makes its best efforts to ensure the accuracy of the contents and information included in the Website, these are general and merely informative. Consequently, The Port is not responsible for the decisions taken by the User based on the information provided through the Website, nor for the damages caused to the User or third parties, due to actions based on the information obtained from the Website.

In order to help you find additional information, we have included various technical linking devices that allow the User to access other websites (hereinafter, “Linked Sites”). In these cases, El Puerto acts as an intermediary service provider, according to the provisions of Article 17 of Law 34/2002, of July 11, 2002, of the Information Society and Electronic Commerce Services Act (Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico). In accordance with the provisions of the aforementioned legislation, El Puerto will not be responsible for the services and content provided through the Linked Sites, unless it has actual knowledge of the unlawfulness and has not disabled the link with due diligence.

The use of the Website is governed by and construed in accordance with Spanish law and it shall be understood that, by using the Portal, the User agrees that any conflict or dispute arising between you and us shall be dealt with exclusively by the competent courts and tribunals in accordance with the applicable legislation.

In the event that any of the provisions contained in these General Conditions is declared null and void, it will be withdrawn or replaced. In any case, such declaration of nullity shall not affect the validity of the remaining provisions contained in these General Conditions.
